Default Defective disk

My W98 disk is kaput, several cracks running outward from the center
have rendered it unusable.

The supplier of my PC with which W98 was supplied has gone belly up,
Microsoft understandably redirects all service issues to the supplier.
Is there a way to get the disk replaced?

I'd stick with the first two options and in both cases make sure that the
copy that you get is not a pirated copy. The third option (though you had
ownership at one time) is illegal in most countries. While you may not get
caught in the process of doing so you'd still have to think about your
actions perhaps? Maybe you have a friend who's upgraded to XP and is no
longer using their copy of 98? If they no longer had it installed on their
computer they might be able to legally give you their copy. The EULA is
rather full of legal-speak for me to interpret but I know that it only
allows (under MOST conditions) for you to have it installed on a single
computer and to have a single backup disk. When the original is sold or
given away the backup copy must be destroyed (though I think you might be
able to give that to the same person as well, I don't see where there's
anything wrong with that but I'm certainly not a lawyer.) It's pretty likely
that you can find someone who's upgraded and quite willing to give you their
copy of 98... I know that I would certainly give away mine if someone asked
me for it.

If you have upgraded your operating system from (say) Windows 98 to Windows
98SE, using the Windows 98 copy as you qualifying product for the upgrade,
you are _not_ allowed to give or sell the Windows 98 copy to someone else. -
it becomes part of your current licensed software and you must treat the
original Windows 98 and the upgrade Windows 98SE as a single licensed
product. In any case, you need your Windows 98 CD in order to prove you are
eligible to install Windows 98SE should that ever be required.

If you have upgraded your operating system from (say) Windows 98 to Windows
98SE but you used a full version of Windows 98SE to do the upgrade, and
Windows 98 was not required as a qualifying product, then you can give away
or sell your Windows 98SE, provided any special conditions are met, such as
not using it other than with the original hardware as some OEM versions
require.

I knew someone would know the specifics Me? I know you can't just go
about burning copies and giving them away without breaking some sort of law.
That does lead me to a question...

If I have 98 and the upgrade CD to 98se where the upgrade requires the
pre-installation of 98 and thus relies on the initial product as a part of
it's licensing agreement would it be fine if I gave away one or both CDs
assuming that I didn't have either of those to products installed any
longer?

Note: that should be "If you have upgraded your operating system from (say)

the upgrade, and Windows 98 was not required as a qualifying product, then
you can give away or sell your Windows 98,..." not "then you can give away
or sell your Windows 98SE,..." The requirement to keep your original
product should be fairly obvious from the need to have the CD to do a
re-install, but a lot of people miss it.

If your SE cd was an upgrade you can sell it or give it away (providing you
revert your system to 98), or you can sell or give away the original and the
upgrade as a combination.

All above of course subject to any additional restrictions, such as hardware
conditions attached to some OEM licenses.
